Anticipatory bail was denied to the petitioner.
Summary
Satya Narayan Singh, a managing director of M/s Agrolimes Overseas Pvt. Ltd., was not named in the FIR but was implicated in a cyber‑fraud case involving alleged digital arrest and large monetary transactions. The FIR alleged offences under Sections 419, 420, 467, 468, 471 and 120B of the IPC and Sections 66(C) and 66(D) of the IT Act, 2000. The petitioner sought anticipatory bail, arguing that he was merely a suspect, had a clean antecedent and that the alleged withdrawals exceeded ATM limits. The investigating officer produced bank records showing Rs 3.85 crore credited and Rs 3.82 crore debited from the company’s account within 26 days, suggesting involvement in the fraud. The court held that the magnitude of the suspicious transactions and the petitioner’s role as managing director justified denial of bail, and consequently rejected the anticipatory bail application.
Issues considered
- Whether anticipatory bail can be granted to a person not named in the FIR but alleged to be involved in cyber‑fraud based on suspicion alone
- Whether the large suspicious bank transactions and the petitioner’s position as managing director warrant denial of bail
