Holding
Anticipatory bail was denied because of the serious nature of the offences and the petitioner’s prior criminal record.
Summary
Satish Kumar petitioned for anticipatory bail after learning that he was likely to be arrested in a case alleging offences under Sections 341, 324, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. The allegation is that he, together with three co‑accused, fired at an informant, causing a firearm injury to the informant's left leg. The petitioner has a prior criminal antecedent. The court examined whether the seriousness of the alleged offences and the petitioner’s criminal history warranted the grant of anticipatory bail. Considering the nature of the accusations and the antecedent, the court held that the petition for anticipatory bail could not be entertained. Consequently, the petition was dismissed.
