Patna High Court

Md. Aarju EmamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail must be granted in the present case.

Summary

The petitioner, Md. Aarju Emam, was arrested in connection with a robbery and assault case (Kalyanpur PS Case No. 262 of 2025) alleged under sections 309(6) and 317(2) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act, 1959. He contended that his confession to police was false, no incriminating articles were recovered from him, and he had not been produced for a T.I. parade despite being in custody since 27‑07‑2025, though a chargesheet had been filed. The State opposed his bail application. The Court, after considering the FIR, the lack of seized material, the absence of a T.I. parade, and the petitioner’s clean record, ordered that regular bail be granted on a bond of Rs.10,000 with two sureties of equal amount, subject to satisfaction of the Chief Judicial Magistrate, Samastipur. The order effectively released the petitioner pending trial.

Issues considered

  • Whether regular bail should be granted to the accused under sections 309(6) and 317(2) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act, 1959.
  • Whether the absence of incriminating articles and the failure to produce the accused for a T.I. parade justify bail despite the seriousness of the offences.
