Patna High Court

Sonal Kumar Sharma @ Sonal Sharma @ Sonal KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that regular bail could not be granted due to the serious nature of the offences and the petitioner’s criminal antecedents.

Summary

The petitioner, Sonal Kumar Sharma, was arrested in connection with a case of extortion and related offences under multiple sections of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged that he demanded a ransom of Rs.5,00,000 and caused injury to the victim. The petitioner, who has been in custody since 23‑11‑2025 and has six prior criminal convictions, applied for regular bail. The court examined the seriousness of the charges, the presence of substantial investigative material, and the petitioner’s antecedents. Considering the gravity of the offences and the risk of tampering with evidence, the court declined to grant regular bail. The order was limited to the bail application and does not prejudice the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail under the Bharatiya Nyaya Sanhita, 2023 given the seriousness of the offences and his criminal antecedents
  • Whether the nature of the offences and the investigation warrant denial of bail
