Patna High Court

Buttan YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioners subject to specified conditions.

Summary

The petitioners Badal Yadav, Buttan Mandal and Buttan Yadav were arrested in connection with FIR No. 64 of 2025 alleging offences under Sections 103(1), 238, 61(2) of the Bharatiya Nyay Sanhita, 2023 and Section 27 of the Arms Act, wherein the informant claimed the accused fired on his family causing a death. The petitioners contended that the FIR does not specifically implicate them and that they are innocent, pointing out the lack of any overt act attributed to them in the charge‑sheet. The prosecution, represented by the Additional Public Prosecutor and the informant’s counsel, argued that the accused had indeed fired on the victim and highlighted the criminal antecedents of one accused. The Court examined the material on record, noted the absence of a direct allegation against the petitioners, and considered their clean antecedents (except for one who is on bail in other cases). Accordingly, the Court granted bail to all three petitioners on a bond of Rs. 10,000 with two sureties, subject to conditions of cooperation, presence in court, non‑tampering with evidence, and verification of criminal antecedents.

Issues considered

  • Whether bail should be granted to the accused under Sections 103(1), 238, 61(2) of the Bharatiya Nyay Sanhita, 2023 and Section 27 of the Arms Act.
  • Whether the FIR and charge‑sheet sufficiently link the petitioners to the alleged firing and death.
  • Whether the petitioners' criminal antecedents justify denial of bail.
