Holding
The court held that anticipatory bail could not be granted as the allegations were serious and the petitioner was implicated in the offences.
Summary
The petitioner, Quadir Alam, sought anticipatory bail fearing arrest in a cyber‑P.S. case (No. 18 of 2025) involving alleged withdrawal of Rs 373,812.80 from an informant’s bank account. The prosecution alleged that the petitioner was named in a self‑inculpatory statement of co‑accused Rakesh Kumar and was involved in offences under Sections 318(4) and 319(2) of the BNS. The court examined the seriousness of the allegations and the petitioner’s alleged participation in the crime. Considering the gravity of the case, the court declined to grant anticipatory bail. Consequently, the application was dismissed and the petitioner was ordered to surrender within four weeks and apply for regular bail, failing which the police were directed to arrest him.
