BAIL GRANTED

Holding

Bail was granted to the petitioner as the circumstances did not justify continued detention.

Summary

The petitioner, Dharmendra Rai, applied for bail in a criminal case registered under Section 395 of the Indian Penal Code for a dacoity that occurred on 27 August 2019, during which jewellery, other articles and cash were stolen. The prosecution alleged that a group of 10-15 unknown persons committed the offence, but the petitioner was not named in the FIR, had not been subjected to a test identification parade, and no stolen items were recovered from his possession. The petitioner had been in custody since 17 December 2020, while a co‑accused in a similar circumstance had previously been granted bail. The State opposed the bail application, arguing the seriousness of the offence. Considering the lack of incriminating evidence against the petitioner, the parity with the co‑accused, and the length of custody, the Court allowed the bail application, ordering release on a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the accused in a dacoity case under Section 395 IPC when the accused is not named in the FIR, has not been identified, and no stolen property has been recovered.
