Patna High Court

Ranjay Sahani @ Ranjay KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, subject to bond and surety conditions.

Summary

Petitioner Ranjay Sahani sought bail in a case registered as Muffasil P.S. No. 277 of 2021, wherein he was charged under IPC Sections 384, 387, 120(B) and 506 for alleged extortion and related offences. The prosecution alleged that a co‑accused, Rahul, had demanded rangdari from an informant via phone calls, while the petitioner’s counsel argued that he was falsely implicated and that the mobile phone evidence was recovered from another co‑accused, Oversiyar Sahni, who had already been granted bail. The petitioner had been in judicial custody since 2 April 2025, and the State opposed bail on the ground of five prior criminal cases. After hearing both sides, the court considered the lack of direct evidence against the petitioner and the circumstances of his detention. The court consequently ordered that the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties and subject to conditions of cooperation and weekly attendance before the police.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences (IPC 384, 387, 120(B), 506) and his alleged criminal antecedents.
