DISMISSED

Holding

The court denied bail, holding that the circumstances did not warrant its grant.

Summary

Prem Sagar Kumar was arrested on 26 July 2024 in connection with a robbery under Section 394 of the Indian Penal Code, where unknown assailants allegedly looted Rs. 2,500 and a mobile phone. The looted mobile phone and a country-made pistol were recovered from the petitioner. He applied for regular bail, which was first rejected on 16 April 2025. The petitioner made a second bail application, arguing that the trial was nearing its conclusion. The court, noting the seriousness of the offence, the recovery of the weapon and stolen items, and that the trial was close to completion, declined to review its earlier order and dismissed the bail application, directing the lower court to expedite the trial.
