Patna High Court

Gautam Singh @ Gautam Kumar SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Gautam Singh, applied for regular bail in a case registered under Sections 103 and 3(5) of the B.N.S., where he is accused of killing his wife for dowry. The prosecution alleges murder, while the petitioner’s counsel contends that the death was a suicide resulting from a trivial argument and that the petitioner has been falsely implicated. The counsel also highlighted that only one witness was examined and that the petitioner has a prior criminal antecedent but has been in custody since 12‑08‑2025. The State opposed the bail, but the court considered the length of custody and the circumstances of the alleged suicide. The court allowed the bail, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties of the same amount.

Issues considered

  • Whether regular bail should be granted to the accused in a dowry‑death murder case under Sections 103 and 3(5) of the B.N.S.
  • Whether the circumstances of the deceased’s death (suicide claim) and the period of custody justify bail

5 21-04-2026 Heard learned Senior Counsel for the petitioner and

learned Additional Public Prosecutor for the State.

                                2. The petitioner seeks bail in connection with

Tilauthu P.S. Case No. 130/2025 registered for the offences

                   punishable under Sections 103, 3(5) of B.N.S.

                                3. As per the prosecution case, petitioner is the

husband of the deceased and he is alleged to have killed the

                   deceased for dowry.

                                4. Learned counsel for the petitioner submits that

petitioner is innocent and has falsely been implicated in the

present case. Learned counsel next submits that from the

records, it appears that the deceased committed suicide because

the petitioner did not take her to attend a marriage and in the

trial out of 11 only one witness has been examined. Learned

counsel further submits that petitioner has one criminal

antecedent and he is in custody since 12.08.2025. The petitioner

undertakes to co-operate in the case/ trial.

                                     5. Learned APP for the State has opposed the prayer

for regular bail of the petitioner.

                                     6. Considering the period of custody of the petitioner

and the fact that the deceased committed suicide over a trivial

argument, this application for regular bail is allowed.

                                     7. Accordingly, let the petitioner, above named, be

released on bail on furnishing bail bonds of Rs. 10,000/- (Ten

Thousand) with two sureties of the like amount each to the

satisfaction of the learned Judicial Magistrate, Rohtas at
