JAI PRAKASH RAM @ DR. JAIPRAKASH RAMversusTHE STATE OF BIHAR

Holding

Anticipatory bail was denied as the court was not inclined to grant it based on the allegations.

Summary

The petitioner, Jai Prakash Ram, sought anticipatory bail fearing arrest in a case (Mohania P.S. Case No. 732 of 2025) involving alleged note‑doubling under several sections of the Bihar Narcotic Substances Act. The prosecution alleged that the petitioner and a co‑accused, Pankaj Singh, were involved in the crime. The petitioner contended that only Pankaj Singh was responsible. The High Court, after hearing counsel, was not persuaded by the petitioner's claim and found sufficient ground to deny anticipatory bail. Consequently, the application for anticipatory bail was dismissed and the petitioner was ordered to surrender within four weeks to apply for regular bail.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the allegations under the Bihar Narcotic Substances Act.
  • Whether the petitioner’s claim of non‑involvement is sufficient to merit anticipatory bail.
