Patna High Court

Raja YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, finding that the evidence on record did not warrant continued pre‑trial detention.

Summary

The petitioner, Raja Yadav Ramdeo Yadav, applied for bail in a case registered under Sections 103(1) and 3(5) of the Bihar Narcotic Substances Act, 2023 and Section 27 of the Arms Act. The informant alleged that the petitioner's daughter‑in‑law, with the assistance of goons, murdered his wife. The petitioner was not named in the FIR; the only material linking him to the crime was his mobile contact with co‑accused Rakhi Kumari, and no further evidence of participation was presented. He had been in custody since 8 April 2025 and a chargesheet had been filed. The State opposed bail, but the court, considering the nature of the accusation and the period of custody, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences alleged under the B.N.S. Act and the Arms Act.
  • Whether the material linking the petitioner to the alleged crime is sufficient to justify continued detention.
