Ranjeet Paswan @ Ranjit Paswan @ BabuversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that bail could not be granted as the offence under Section 392 IPC is serious, the trial has commenced, and the petitioner is implicated in multiple similar cases.

Summary

Ranjeet Paswan was charged under Section 392 of the Indian Penal Code for robbery with hurt in Gurua P.S. Case No. 02 of 2022. He had previously applied for bail, which was rejected, and made a second bail application. The court noted that his name appeared in the self‑inculpatory statements of co‑accused and that he is also implicated in six other similar serious cases, having been in custody since December 2024. The trial had already commenced with one witness examined. Considering the gravity of the offence, the multiple charges, and the fact that the trial was underway, the court declined to grant bail and dismissed the application.

Issues considered

  • Whether bail should be granted to an accused of a serious offence under Section 392 IPC when the trial has already commenced.
  • Whether the petitioner’s implication in multiple similar cases and his custodial status affect the grant of bail.
