Patna High Court

Gorelal Ramani @ GurujeeversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

The petitioner, Gorelal Ramani, sought bail in a murder case (Sections 302/34 IPC) for which he has been in custody since 19 June 2024. He argued that he was never named in the FIR and that no substantive evidence links him to the crime, citing that a co-accused was previously granted bail. The prosecution opposed bail, highlighting the petitioner’s nine prior criminal antecedents, though noting he is out on bail in other pending matters. The court examined the lack of material evidence, the petitioner’s alleged innocence, and the precedent of bail to a co-accused, and decided to grant bail with a Rs.10,000 bond and two sureties. The bail was conditioned on the petitioner’s cooperation with the trial, presence in court, non‑tampering with evidence or witnesses, and verification of his criminal antecedents.

Issues considered

  • Whether bail should be granted to the accused in a murder case under Sections 302 and 34 IPC given the absence of his name in the FIR and lack of substantive evidence.
  • Whether the petitioner’s prior criminal antecedents justify denial of bail.
