Decided

BAIL GRANTED

Holding

No offence under Section 307 IPC is made out, and the anticipatory bail application is allowed.

Summary

The petitioner, Rahul Kumar, sought anticipatory bail fearing arrest in a case (Mohanpur P.S. Case No. 97 of 2025) involving alleged offences under several sections of the Bihar Negotiable Service (BNS) Act. The prosecution alleged a trivial dispute leading to grievous injury, while the petitioner claimed innocence and that no head injury existed. The court examined whether the facts established an offence under Section 307 of the Indian Penal Code. Finding that no such offence was made out, the court allowed the bail application. The petitioner was directed to obtain bail on a bond of Rs.10,000 with two sureties, subject to conditions of Section 438(2) CrPC and Section 482 of the BNS Act.

Issues considered

  • Whether the facts constitute an offence under Section 307 of the Indian Penal Code
  • Whether anticipatory bail can be granted under Section 438(2) of the Code of Criminal Procedure, 1973
