The Court held that the petitioner is not an accused under the FIR and is entitled to bail under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Summary
Megha Jha, the petitioner, sought bail fearing arrest in a case registered under Sections 103(1), 238 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 relating to a murder alleged to have occurred on 31 July 2024. The FIR named co‑accused Sachin Kumar Jha and Shashi Kapoor Jha as the perpetrators; the petitioner was merely present at the scene and no specific allegation of assault was made against her. Her counsel argued that she is not an accused, has a clean antecedent and should be released on bail. The State opposed the bail application. The Court, after considering the facts, granted bail on a bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Issues considered
- Whether the petitioner, who was present at the scene but not charged, is entitled to bail under the provisions of the Bharatiya Nyaya Sanhita and Bharatiya Nagarik Suraksha Sanhita.
- Whether the allegations against the petitioner constitute an offence under Sections 103(1), 238 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
- Whether bail can be granted under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
