Patna High Court

Raju Kumar SinghversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that there is no ground to grant bail and refused to review its earlier order denying bail.

Summary

The petitioner, Raju Kumar Singh, applied for regular bail in a case involving kidnapping and murder under Sections 140(1), 103(1), 238 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. This was his second bail application after a prior rejection on 23‑04‑2025. The prosecution alleged that the petitioner aided the informant and another accused in killing the victim, and he had been in custody since 15‑12‑2024. The learned Assistant Public Prosecutor opposed bail, emphasizing the seriousness of the offences and the fact that charges had been framed and trial commenced. Justice Sandeep Kumar found no sufficient ground to overturn the earlier order and declined to grant bail. Consequently, the bail application was dismissed.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the grave nature of the offences of kidnapping and murder.
  • Whether the High Court can review its earlier order denying bail.

                                                           4. Several conversations were made
between the informant and Vinay Kumar Singh. The
petitioner has helped the informant and Vinay Kumar
Singh in killing the deceased. He is in custody since
                                              15.12.2024.
                                                           5. Learned APP appearing for the State
opposes the prayer for regular bail of the petitioner.
                                                           6. Considering the allegation levelled
against the petitioner, I am not inclined to grant bail to
                                              the petitioner.
                                                           7. Accordingly, the application stands
                                              dismissed.

                                   4. The charges have been framed in the case and the

trial has started. This Court finds no ground to review its earlier

order. Accordingly, this application for regular bail is rejected.
