Patna High Court

Sushila DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, considering the prolonged custody and the fact that co‑accused have been granted bail, the petitioner is entitled to regular bail.

Summary

Sushila Devi, the mother‑in‑law of a deceased woman, was arrested in connection with a dowry‑death case (IPC §§304B/34) on 21‑06‑2023. She filed three bail applications; the first two were rejected. The petitioner argued that she is innocent, has been in custody for a long period, and that co‑accused have already been granted anticipatory or regular bail. The State and the informant opposed the bail. The court, noting the extended custody and the bail granted to co‑accused, allowed the regular bail with a bond of Rs.10,000 and two sureties, subject to conditions of regular appearance. Consequently, the petitioner was released on bail.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged under IPC §§304B and 34.
  • Whether the duration of custody and the grant of bail to co‑accused influence the bail decision.
