Decided
Disposal
BAIL GRANTED

Holding

The court allowed the bail application and ordered the release of the petitioners on bail subject to statutory conditions.

Summary

The petitioners, five residents of Kanchhedwa village, feared arrest in connection with Harsidhi police station case No. 374 of 2025, which alleged offences under several sections of the Bihar Narcotic Substances Act, 2023, including assault. The prosecution alleged that the petitioners had assaulted the victim, while the petitioners contended they were innocent and falsely implicated, also mentioning the death of a person from their side in a related counter‑blast case. They filed an application for bail before the Patna High Court. The learned judge considered their apprehension of arrest, the claim of innocence, and the statutory provisions governing bail. The court allowed the application, directing that the petitioners be released on bail upon furnishing a bond of Rs 10,000 with two sureties, subject to the conditions of Section 438(2) of the Code of Criminal Procedure, 1973 and Section 482 of the Bihar Narcotic Substances Act. The order stipulated that bail be granted if the petitioners surrender or are arrested within four weeks.
