Holding
Anticipatory bail was denied as the court was not convinced that the petitioner warranted pre‑arrest liberty.
Summary
The petitioner, Dev Yadav, filed a second anticipatory bail petition in the Patna High Court after an earlier petition was rejected on 13‑08‑2025. The petition sought pre‑arrest bail on the ground that he was accused of brutally assaulting the son of an informant, an allegation supported by an injury report documenting multiple injuries. The court examined the specific nature of the accusation, the material evidence on record, and the surrounding circumstances of the case. Considering the seriousness of the alleged assault and the strength of the prosecution’s evidence, the court found no sufficient ground to grant bail. Consequently, the petition for anticipatory bail was rejected, and the petitioner was ordered to remain subject to arrest. The order was delivered by Justice Prabhat Kumar Singh on 09‑02‑2026.
