Patna High Court

Karan SinghversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court refused to grant bail, ordering the trial to be concluded within two months and allowing a fresh bail application thereafter.

Summary

Karan Singh was charged with murder, criminal conspiracy and illegal possession of arms under IPC Sections 302, 120B/34 and Arms Act Section 27. His earlier bail petition was rejected, with a direction that he could renew after six months if the trial was not concluded. The petitioner now sought regular bail, arguing that the prosecution evidence had been closed and the case was at the stage of recording statements under Section 313 CrPC. The High Court observed that the trial was at its final stage and declined to grant bail, directing the trial court to finish the trial within two months. The petitioner was permitted to file a fresh bail application after two months if the trial remains pending.

Issues considered

  • Whether regular bail can be granted to the accused at the final stage of trial after prosecution evidence is closed
  • Whether the earlier direction to renew bail after six months applies in the present circumstances
