Anticipatory bail was not granted to the petitioner.

Summary

Pappu Singh applied for anticipatory bail in a criminal case arising from an alleged illegal sand‑mining offence. The charges include theft and dishonest misappropriation of property under IPC sections 379 and 411, as well as violations of the Mines and Minerals (Development and Regulation) Act, 1957 and the Bihar Mining (CPIMTS) Amendment Rules, 2019. The petitioner argued that the allegations were general and that no incriminating material had been seized. The Court examined the nature of the allegations and the statutory provisions involved. Finding the allegations serious, the Court declined to grant anticipatory bail, ordered the petitioner to surrender within four weeks, and directed him to seek regular bail, warning that the police would arrest him if he failed to comply.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the alleged offences under IPC, the Mines and Minerals (Development and Regulation) Act and the Bihar Mining (CPIMTS) Amendment Rules.
