Patna High Court

Ravi Kumar Singh @ Ravi Singh @ Amit SinghversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was refused as the nature of the accusation under the NDPS Act did not merit such relief.

Summary

The petitioner, Ravi Kumar Singh, applied for anticipatory bail in a case where co-accused were found in possession of heroin and had named him as an associate. The prosecution alleged that the petitioner was involved in offences punishable under Sections 21(b), 22(b), 27(a) and 8(c) of the Narcotic Drugs and Psychotropic Substances Act. The petitioner contended that no incriminating material was recovered from him, he has a clean antecedent and is innocent. The State opposed the bail, emphasizing the seriousness of the drug offences. The Court, after hearing both sides, held that the nature of the accusation warranted denial of anticipatory bail. Consequently, the petition for anticipatory bail was refused.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under the NDPS Act given the seriousness of the alleged offences
  • Whether the petitioner’s alleged association with co‑accused justifies denial of bail
