Holding
Bail was not granted as the Court found the allegations serious enough to justify continued custody.
Summary
The petitioner, Sanjeet Kumar, was charged under Sections 137(2), 142, 143(4), 111 and 61(2) of the BNS for allegedly purchasing a six‑month‑old child who had been kidnapped and sold by unknown criminals. He has been in custody since 5 September 2025. The petitioner applied for bail, arguing that he should be released pending trial. The prosecution contended that the allegations were serious, involving child kidnapping and trafficking. The Court, after hearing both sides, held that the gravity of the offences warranted continued detention and therefore refused bail. The bail application was dismissed.
