BAIL GRANTED

Holding

The court held that the petitioner is entitled to bail given the consensual nature of the alleged relationship and the victim’s status as a major.

Summary

The petitioner, Anil Kumar Kharwar, was arrested in connection with an offence under Section 87 of the Bihar Narcotic Substances Act, 2023, after a missing‑person complaint involving the informant’s daughter. The FIR alleged that the daughter, a major, had a consensual relationship with the petitioner and was later implicated under pressure from her parents. The petitioner applied for bail, arguing that the relationship was consensual and that the victim’s statement under Section 183 of the BNSS confirmed her majority. The State opposed the bail. Considering the facts, the court granted bail on a bond of Rs.10,000 with two sureties and conditions for appearance, retaining the power to cancel the bail for non‑appearance.
