Patna High Court

Md. Sk Kamran @ Md. kamranversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner with specified conditions despite his prior antecedents and suppression of facts.

Summary

The petitioner, Md. Sk Kamran, was charged under IPC sections 379, 411, 413 and 414 for alleged theft of a motorcycle, with co‑accused statements implicating him. He had been in custody since 1 October 2024 and possessed two prior criminal antecedents of a similar nature, which he had suppressed during the earlier bail application. Although a prior bail order was issued on 7 May 2025, the lower court rejected the bail bond on account of the suppressed antecedents. The High Court considered the length of his pre‑trial detention and the nature of the offences, and decided to grant regular bail subject to a cash bond of Rs 10,000, two sureties who are blood relatives, and a condition of appearing at the police station every Sunday. The order also required personal or advocate‑represented appearance in court on trial dates, with bail liable to cancellation on default.
