The court granted bail to the petitioner on condition of a Rs 10,000 bond and two sureties.
Summary
The Patna High Court heard a bail application filed by Hareram Mahto, husband of a woman who died allegedly by suicide. He was charged under Sections 304B and 34 of the Indian Penal Code for dowry death. The petitioner argued that the death was a suicide, that he was falsely implicated, and that he had a clean antecedent, having been in custody since 10 January 2024 with charge framed only on 20 January 2025. The court examined the long period of pre‑trial detention and the lack of substantive evidence linking the petitioner to a dowry‑related homicide. Considering these factors, the court ordered his release on bail upon furnishing a bond of Rs 10,000 with two sureties of the same amount. The order was pronounced by Justice Prabhat Kumar Singh.
Issues considered
- Whether the petitioner is entitled to bail despite being charged under IPC Sections 304B and 34
- Whether the circumstances of the deceased's death constitute a dowry death or suicide
- Whether the length of pre‑trial detention justifies granting bail
