Decided
Disposal
DISMISSED

Holding

Anticipatory bail is not granted to the petitioner.

Summary

The petitioner, Ketu Sahni, was implicated in a loot case involving assault and theft of jewellery, based on a confessional statement of a co‑accused, and is also named in two other criminal matters. He filed an application for anticipatory bail under Section 438 of the Criminal Procedure Code for offences under IPC Sections 394, 395 and 412. The Court examined the seriousness of the allegations, the petitioner’s involvement as indicated by the co‑accused’s confession, and the existence of multiple pending cases. Concluding that the circumstances did not warrant the grant of anticipatory bail, the Court dismissed the application. The petitioner was ordered to surrender before the lower court within four weeks and to seek regular bail, failing which the police were directed to arrest him.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the allegations under IPC Sections 394, 395 and 412
  • Whether the confessional statement of a co‑accused is sufficient to deny anticipatory bail
