The court held that the petitioners are entitled to regular bail as the prosecution failed to substantiate the allegations and there is no likelihood of interference with the investigation.
Summary
The Patna High Court heard bail applications filed by four women (Hina Khatoon, Salo Khatoon, Jugani Khatoon, and Shabnam Khatoon) who were in judicial custody for alleged offences under the Bihar Narcotic Substances Act, the POCSO Act and the Immoral Traffic (Prevention) Act. The prosecution alleged that a search of Shabnam Khatoon's house yielded two girls and a customer in an objectionable position, leading to charges under multiple sections of the aforementioned statutes. The petitioners contended that they were falsely implicated on mere suspicion, that victim statements were not recorded as directed, and that they had no criminal antecedent. The State opposed bail, citing the seriousness of the offences. After considering the lack of substantive evidence, the similarity to a previously granted bail order, and the petitioners' prolonged custody since August 2025, the court ordered regular bail on a bond of Rs.10,000 with two sureties for each petitioner.
Issues considered
- Whether the petitioners are entitled to regular bail despite charges under the BNS, POCSO and ITPA statutes.
- Whether the failure to record victim statements and the reliance on an informant render the prosecution's case weak enough to justify bail.
- Whether the petitioners pose a risk of tampering with evidence or influencing witnesses.
- Whether the precedent of a similar bail order in Cr. Misc. No. 80793 of 2025 is applicable.

objectionable position. When they were interrogated, they
disclosed their name as Mausami Khatoon, Shabnam Khatoon
and Abdul Jabbar.
4. Learned counsel for the petitioners has submitted
that the petitioners are innocent and have committed no offence.
They have falsely been implicated by the informant merely on
the basis of suspicion. Learned counsel has further submitted
that from perusal of the case diary, it appears that the I.O. of this
case has not recorded the statement of the victims/women who
have been recovered from the place of alleged occurrence
despite direction of the Supervising Authority to record the
statement of the victims/women. As such, only allegation
against the petitioners is only the F.I.R. A statement has been
made in para-3 of these petitions that the petitioners have got no
criminal antecedent. It has also been submitted by learned
counsel for the petitioners that similarly situated other co-
accused person has already been granted bail by this Court vide
order dated 03.12.2025 passed in Cr. Misc. No. 80793 of 2025.
The case of this petitioner stands on similar footing. Moreover,
they are languishing in judicial custody since 09.08.2025.
5. Learned Additional Public Prosecutor for the State
has vehemently opposed the prayer of bail to the petitioners.
