Holding
The court allowed the petition for regular bail, directing the petitioner’s release upon furnishing the required bond and sureties.
Summary
The petitioner, Arvind Kumar, was arrested in connection with a dowry‑death case (Dinara P.S. Case No. 184/2025) alleging his involvement in the killing of his wife. He claimed he was absent from the scene, working in Delhi, and that the deceased died of natural causes after being taken to a hospital. The petitioner presented a clean antecedent and offered to cooperate with the investigation, while the prosecution opposed regular bail. The court examined the allegations, the petitioner’s alibi, and the lack of prior criminal record. Considering these facts, the court granted regular bail on the condition of a Rs.10,000 bond with two sureties.
Issues considered
- Whether the petitioner is entitled to regular bail despite the serious nature of the dowry‑death allegations
- Whether the petitioner’s alibi and clean antecedent justify the grant of bail
