Bail was granted to the petitioner subject to a bond of Rs. 10,000 and specified conditions.
Summary
The petitioner, Md. Abrar Warsi, was arrested on 2 December 2023 in connection with a murder case (Rosera P.S. Case No. 503 of 2023) involving offences under Sections 302, 120(B), 34 of the IPC and Section 27 of the Arms Act. The prosecution alleged that hired criminals carried out the killing, while the petitioner claimed he was falsely implicated, asserting that his name appeared only in a confessional statement of co‑accused Vicky Kumar and that no other material linked him to the crime. The State opposed bail, alleging the petitioner had confessed guilt and had two other pending cases, though it also noted he was on bail in those matters. The Court examined the lack of substantive evidence against the petitioner and the conditions of his alleged confession, and decided to grant bail on a bond of Rs. 10,000 with two sureties, subject to strict conditions regarding trial attendance, non‑tampering with evidence or witnesses, and verification of criminal antecedents. The order directed the lower court to release the petitioner on bail pending trial.
Issues considered
- Whether bail should be granted to the petitioner accused of murder, conspiracy and arms offences in the absence of substantive evidence beyond a co‑accused's confessional statement.
- Whether the petitioner’s alleged confession and pending cases justify denial of bail.
