Patna High Court

Azaharuddin Beig @ Laddan MiyanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the petition for regular bail, directing the petitioner to be released on bail upon furnishing the prescribed bond and sureties.

Summary

The petitioner, Azaharuddin Beig, was charged with several serious offences under the Indian Penal Code (sections 147, 148, 149, 341, 506, 307, 427, 120(B)) and Section 27 of the Arms Act for allegedly participating in an attack on an informant. He has been in custody since 1 August 2017, with charges framed on 28 May 2019, and the trial remains pending. The petitioner sought regular bail, arguing that co‑accused have already been released on bail and that the trial has progressed slowly. The State opposed the bail application, citing the gravity of the offences. The Court considered the prolonged detention, the nature of the accusations, and the bail granted to similarly situated co‑accused, and consequently allowed the petition for regular bail on the condition of a bail bond and sureties. The order directs the petitioner to be released on bail upon furnishing the required security.

Issues considered

  • Whether regular bail should be granted to a petitioner charged with multiple serious offences under the IPC and the Arms Act, considering the length of pre‑trial detention and the slow progress of the trial.
