Satendra Singh @ Satyendra SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to bail, subject to specified conditions.

Summary

Satendra Singh, the petitioner, was in custody since 28 August 2025 for alleged offences under Section 7(a) of the Prevention of Corruption Act, 1988, involving a demand for a bribe in a land mutation matter. The prosecution alleged that he demanded Rs.1 lakh, settled for Rs.30,000, and accepted Rs.20,000, of which Rs.12,500 was recovered from his possession. The petitioner claimed a clean antecedent, asserted that the allegations were fabricated, and argued that the recovered money was his own. The Vigilance department opposed bail. The court, considering the petitioner’s clean record and the period of custody, granted bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, presence in court, and non‑tampering with evidence or witnesses.

Issues considered

  • Whether the petitioner is entitled to bail under the provisions of the Criminal Procedure Code in a case punishable under Section 7(a) of the Prevention of Corruption Act, 1988
  • Whether the petitioner’s clean antecedent and the duration of custody justify the grant of bail
