SATYANARAYAN KESHARI @ SATYANARAYAN KUMAR @ SATYANARAYAN KUMAR KESHARI @ SATYA KESHARIversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, given the victim’s voluntary statement, the alleged love affair, and the petitioner’s clean record, bail should be granted.

Summary

The petitioner, an 18‑year‑old male, was arrested for alleged kidnapping of a minor girl, the daughter of the informant, under Section 96 of the B.N.S. The prosecution alleged the girl was enticed and might be sold for prostitution. The petitioner contended the incident stemmed from a consensual love relationship and the victim, now married and pregnant, gave a statement under Section 183 of the B.N.S.S. that she left home voluntarily, has reconciled with her family, and refused medical examination. The court considered the victim’s statement, the possibility of a love affair, the petitioner’s clean record, and the lack of evidence of coercion. Accordingly, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to bail for an alleged kidnapping of a minor under Section 96 of the B.N.S.
  • Whether the victim’s voluntary statement under Section 183 of the B.N.S.S. and the alleged compromise affect the grant of bail
