Patna High Court

Deepak Singh @ Deepak KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond of Rs.10,000 and two sureties.

Summary

The petitioner, Deepak Singh, was arrested in connection with the seizure of 147.78 litres of liquor and three blank cartridges from a Swift Dzire car. He was charged under Sections 191(2), 191(3), 109, 132, 324(4) of the B.N.S. and Sections 26, 27, 35 of the Arms Act. The petitioner argued that he neither owned the vehicle nor had the contraband in his conscious possession, no police officer was injured, and that other co‑accused had already been released on bail. The State opposed bail, citing the general and omnibus nature of the allegations and the fact that a charge‑sheet had been filed. The Court, noting the lack of direct involvement, the existence of bail for similarly situated co‑accused, and the submission of the charge‑sheet, ordered the petitioner’s release on bail upon furnishing a bond of Rs.10,000 with two sureties.
