Patna High Court

Ravi Kumar Raj @ Ramashankar @ JhunjhunversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, considering the petitioner’s clean antecedents and interim maintenance, anticipatory bail should be granted.

Summary

The petitioner, Ravi Kumar Raj, husband of the complainant Ranjna Kumari, was implicated in a complaint case under Section 498A of the IPC and Sections 3 and 4 of the Dowry Prohibition Act for alleged dowry harassment. He applied for anticipatory bail, asserting his innocence, clean antecedents, and that he was already paying interim maintenance of Rs.8,000 per month as ordered in a separate maintenance case. The State and the complainant opposed the bail, arguing the seriousness of the allegations. The High Court, after considering the nature of the accusations, the petitioner’s clean record, and the maintenance payments, allowed the prayer for anticipatory bail. The court ordered that, if arrested within eight weeks, the petitioner may be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to the conditions of Section 482(2) of the CrPC.

Issues considered

  • Whether anticipatory bail should be granted to the accused in a complaint under Section 498A IPC and Dowry Prohibition Act
  • Whether the petitioner’s clean antecedents and payment of interim maintenance justify the grant of bail
  • Whether the allegations of dowry harassment warrant arrest pending trial

                               3. As per the prosecution case, this petitioner, along

with other F.I.R. named accused persons, is alleged to have

                       4. Learned counsel appearing for the petitioner

submits and petitioner is quite innocent and has committed no

complainant/Opposite Party No. 2. Moreover, petitioner is ready

to keep her with full honour and safety. As a matter of fact, at no

point of time, petitioner committed torture or harassment with

an interim maintenance of Rs. 8,000/- per month to the

complainant and undertakes to continue paying the same till

further orders. Petitioner claims clean antecedent.

                       5. On the other hand, learned A.P.P. for the State and

learned counsel for the complainant/Opposite Party No. 2 have

vehemently opposed the prayer for grant of anticipatory bail to

          the petitioner.
