Patna High Court

Sonu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to bail as the victim’s voluntary departure undermines the abduction charge.

Summary

The petitioner, Sonu Kumar, was arrested in connection with a case registered under Sections 137(2), 87 and 3(5) of the Bihar Negotiable Substances Act for allegedly abducting a girl. He had been in custody since 16 July 2025. The petitioner’s counsel argued that the victim’s statement indicated she left her house voluntarily, casting doubt on the abduction allegation. The court examined whether the circumstances warranted continued detention or bail. Finding the victim’s voluntary departure relevant, the court concluded that the prosecution had not established a strong case for denial of bail. Consequently, the bail application was allowed subject to a bond of Rs.10,000 with two sureties. The petitioner was ordered to be released on bail.

Issues considered

  • Whether the petitioner is entitled to bail despite the charges under Sections 137(2), 87 and 3(5) of the BNS.
  • Whether the victim’s statement that she left her house voluntarily negates the abduction allegation.
