BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to a bail bond, sureties, and a condition to deposit Rs 3,000 per month to the complainant.

Summary

The petitioner, Haribhajan Chaudhary, was implicated in a complaint alleging cruelty, harassment, and dowry demands under IPC sections 498A and 34 and Section 4 of the Dowry Prohibition Act. He contended that he had not committed any offence and sought anticipatory bail, offering to pay Rs. 3,000 per month to the complainant as living expenses pending the final outcome of the case. The complainant’s counsel accepted the offer and requested that the court direct the petitioner to make the monthly payments. The High Court, after hearing both sides, granted anticipatory bail, imposing a bail bond of Rs. 10,000 with two sureties and conditioning the release on the monthly payment to the complainant. The order was made subject to the petitioner’s surrender within six weeks and compliance with the payment condition.

Issues considered

  • Whether anticipatory bail can be granted in a case involving alleged dowry harassment and cruelty under IPC 498A, 34 and Dowry Prohibition Act 4
  • Whether the court may impose a condition that the accused deposit a monthly sum to the complainant as part of anticipatory bail
