Patna High Court

Lalu Kumar @ Lalu PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to the conditions specified by the Court.

Summary

The petitioner, Lalu Kumar, was arrested in connection with a case registered under Sections 25(1‑b)a, 26 and 35 of the Arms Act after a raid recovered a loaded pistol and a knife from his residence. The prosecution alleged that the petitioner was in illegal possession of the firearms, while the petitioner contended that he was falsely implicated due to political rivalry and that the seized items were not in his conscious possession. He had been in custody since 25‑02‑2024 and already faced two other criminal cases. The State opposed the bail application, emphasizing the seriousness of the arms offences. The Court, after considering the facts, directed that bail be granted on the condition of a Rs 10,000 bond with two sureties and several compliance requirements. The order also stipulated that any breach of conditions or concealment of antecedents could lead to cancellation of bail.

Issues considered

  • Whether bail should be granted to the accused in a case under Sections 25(1‑b)a, 26 and 35 of the Arms Act.
  • Whether the political victimisation claim and the existence of prior criminal cases affect the bail decision.
