Aasif @ Prince @ Aasif Javed @ Assif JavedversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Aasif Javed, applied for regular bail in a case involving alleged cyber‑fraud offences under sections 303(2), 319(2), 318(4), 317(2) and 317(5) of the Bihar Narcotic Substances Act and sections 66C, 66D and 84B of the Information Technology Act. The prosecution alleged that Irfan Akhtar, with his brother and associates, defrauded victims and deposited the proceeds in accounts of the associates. During a raid of the petitioner’s residence, only his personal items – a passbook, an ATM card and a mobile phone – were recovered; no incriminating material was found. The petitioner has been in custody since 14 July 2025 and has no prior similar cases, while a co‑accused, Hasan Khan, had been granted anticipatory bail by a coordinate bench. Considering these facts, the court ordered the release of the petitioner on bail with a bond of Rs 10,000 and two sureties, subject to cooperation with the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the alleged cyber‑fraud offences
  • Whether the lack of material seized, absence of prior similar cases, and the grant of anticipatory bail to a co‑accused justify the release on bail
