Patna High Court

Aditya Yadav @ Adit YadavversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court denied bail, holding that the petitioner’s serious charges and Naxal background preclude release.

Summary

The petitioner, Aditya Yadav, was charged in a 2014 case for multiple serious offences under the IPC, the Indian Explosive Act, the UAPA and the CLA Act, including terrorism‑related crimes and use of explosives. He is described as a hardened Naxal with eight prior criminal cases and was an absconder until his arrest in May 2024. The petitioner applied for regular bail for the second time after a prior bail denial in January 2025. The court examined the gravity of the offences, the petitioner’s criminal antecedents and his alleged role as a Naxal operative, and found no sufficient ground to grant bail. Consequently, the bail application was dismissed and the trial was ordered to proceed.

                                                          4. In a case of 2014, the petitioner
was an absconder and he is in jail since
20.05.2024. The petitioner isaccused in eight

                                                          5. Considering the facts of the case
and also considering the fact that the petitioner
is a Naxal, this Court is not inclined to grant
                                              bail to the petitioner.
                                                          6. Accordingly, this application is
                                              dismissed.

                                   4. The petitioner has eight criminal antecedents and

                      he is a hardened Naxal.

                                   5. In view of the above, this Court finds no ground to

review its earlier order. Accordingly, this application for regular

                      bail stands rejected.

                                   6. The Trial Court is directed to proceed in the trial.
