Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to bond and surety conditions under Section 438 CrPC and Section 482 BNSS.

Summary

The petitioner, Sonu Jha, applied for anticipatory bail in connection with Sadar P.S. Case No. 218 of 2025, which alleged offences under Sections 109 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. The incident involved a shooting at a tea shop, but the informant testified that no one was injured and the petitioner’s name does not appear in the FIR. The petitioner’s counsel argued that he is innocent, not named in the FIR, and that the investigation merely produced his name later. The State and the informant opposed the bail, contending the seriousness of the offences. The Court, after considering the lack of injury, the petitioner’s non‑inclusion in the FIR, and the principle of liberty, allowed the anticipatory bail with a bond of Rs.10,000 and two sureties, subject to conditions under Section 482 of the BNSS and Section 438(2) of the CrPC. The order is limited to the bail application and does not prejudice the merits of the trial.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the Code of Criminal Procedure in view of the alleged offences under the Bharatiya Nyaya Sanhita and the Arms Act
  • Whether the petitioner’s non‑inclusion in the FIR and the absence of any injury justify the grant of bail

who is said to be an employee at the bus stand, was sitting in a

tea shop, 5–6 persons arrived at 2–3 motorcycles and started

firing indiscriminately. However, the informant somehow

managed to save himself. The informant also recognized two of

                       4. Learned counsel for the petitioner submits that

petitioner is quite innocent and has not committed any offence.

          He further submits that the petitioner is not named in the FIR;

however, during the course of the investigation, the name of the

petitioner has come. It is also an admitted fact that no one

sustained any injury in the incident.

                       5. Learned APP for the State and learned counsel for

the informant have vehemently opposed the prayer for bail.

                       6. Considering the facts and circumstances of the

case, this application for anticipatory bail stands allowed.

event of arrest or surrender within four weeks from today in the

Court below, be released on anticipatory bail on furnishing bail
