BAIL GRANTED

Holding

Anticipatory bail is granted subject to surrender within eight weeks, a bail bond of Rs.10,000 and two sureties, under Section 482.

Summary

The petitioner, Mintu Kumar Upadhyay, was implicated in a FIR alleging assault with a sword causing a simple head injury to an informant, and faces charges under several sections of the Bhartiya Nyaya Sanhita. He applied for anticipatory bail, asserting a clean antecedent and arguing that the injury was minor. The State opposed the bail, contending the seriousness of the offences. The Court, after considering the nature of the injury and the petitioner's clean record, ordered that anticipatory bail be granted if the petitioner surrenders within eight weeks, subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 482. The order reflects the Court’s discretion to prevent undue harassment while ensuring compliance with the law.
