BAIL GRANTED

Holding

Bail was granted to the petitioner with specified conditions.

Summary

The petitioner, Gautam Yadav, was arrested on 30 August 2025 in connection with a kidnapping case (Nowkothi P.S. Case No. 80 of 2025) under Section 87 of the BNS. He contended that the FIR was fabricated, he has a clean criminal record, and the alleged victim, after being recovered, gave a statement under Section 183 of the BNSS, 2023, refusing to support the prosecution and stating she had married the petitioner and later another person. The State opposed bail, but the court noted the petitioner’s clean antecedent and the victim’s non‑cooperation with the prosecution. Consequently, the court granted bail on a Rs.10,000 bond with two sureties, imposing conditions of cooperation with the trial, non‑tampering with evidence or witnesses, and verification of any concealed criminal antecedent. The bail order was directed to be implemented by the Chief Judicial Magistrate, Begusarai.

Issues considered

  • Whether bail should be granted to the petitioner accused under Section 87 of the BNS in view of the victim’s statement under Section 183 of the BNSS, 2023 and the petitioner’s clean antecedent.
