Patna High Court

Mukesh SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that the petitioner’s prolonged pre‑trial detention without trial warranted the grant of bail.

Summary

Mukesh Singh was arrested in connection with the murder of the informant's father under an FIR dated 2020. He has been in custody since 17 March 2021, amounting to over four and a half years without the trial concluding. The petitioner sought bail for the fourth time after earlier applications were rejected, citing the prolonged detention and that co‑accused had been granted bail. The State opposed bail, arguing the seriousness of the offence. The Court considered the lengthy custody, delay in trial, and the principle of the right to a speedy trial. It held that continued detention would be unjustified and ordered bail on condition of a bond of Rs.10,000 with two sureties. The bail order was directed to be executed by the District & Additional Sessions Judge, Begusarai.

Issues considered
