Patna High Court

Irfan RahmaniversusThe State Of Bihar

Decided
Disposal
BAIL GRANTED

Holding

In the absence of substantive material linking the petitioners to the offence, bail was granted.

Summary

Irfan Rahmani and Rahul Bari were arrested in connection with a case of kidnapping, murder and theft of livestock, alleged under Sections 137(2), 307 and 3(5) of the Bihar Narcotic Substances Act, 2023. The prosecution’s case relied solely on the petitioners' self‑confessional statements, with no other material evidence or recovery linking them to the crime, and they were not named in the FIR. The petitioners argued they have clean antecedents and that the charges are based only on their statements. The court observed that the absence of substantive evidence and the fact that the petitioners were not originally named in the FIR warranted the grant of bail. Accordingly, bail was ordered on a bond of Rs.10,000 each with two sureties, subject to conditions of cooperation, non‑tampering with evidence, and verification of antecedents.

Issues considered

  • Whether bail should be granted when the accused are not named in the FIR and the prosecution's case rests solely on self‑confessional statements.
  • Whether the lack of corroborative material evidence justifies the release of the accused on bail.
