Anticipatory bail was granted to the petitioner.
Summary
The petitioner, Mantu Rajak, sought anticipatory bail fearing arrest in a case registered under Sections 351, 352, 79, 77, 75, 57 and 3(5) of the B.N.S. The prosecution alleged that co‑accused Rupesh Kumar recorded obscene videos of an informant, blackmailed her and, together with other accused including the petitioner, made the video viral. The petitioner contended he had no direct involvement in the recording or dissemination and possessed a clean antecedent. The State opposed the bail application. Considering the lack of specific incriminating act against the petitioner, his clean record, and the general nature of the accusations, the Court granted anticipatory bail, directing a bail bond of Rs.10,000 with two sureties, subject to Section 482(2) of the B.N.S.S.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under the circumstances
- Whether the petitioner’s alleged assistance amounts to a cognizable offence warranting denial of bail
- Applicability of Section 482(2) of the B.N.S.S. in granting bail
