BAIL REJECTED

Holding

The Court refused to grant regular bail to the petitioners.

Summary

The petitioners, Bebi Devi and Pramod Yadav, applied for regular bail in a criminal miscellaneous case (No. 83074 of 2025) before the Patna High Court. They were charged under Sections 191(2), 190, 109, 103, 303(2), 352 and 351 of the Bihar Negotiable (B.N.S.) for allegedly assaulting an informant and his wife with weapons, resulting in the wife's death on the spot. The prosecution alleged that the accused, armed with lathi, danda, iron rod and khati, brutally assaulted the victims. The Court considered the gravity of the offences, especially the homicide, and found the allegations serious enough to deny bail. Consequently, the bail petition was rejected, but the Court directed the trial court to expedite the trial as the petitioners had been in custody since 29‑07‑2025.

Issues considered

  • Whether regular bail should be granted to the petitioners accused of offences under Sections 191(2), 190, 109, 103, 303(2), 352 and 351 of the B.N.S. given the seriousness of the alleged assault and murder.
