Holding
The court held that bail could not be granted because of the seriousness of the offence and the lack of any new ground to alter its earlier orders.
Summary
The petitioner, Dharmendra Kumar, filed a third application for regular bail in a Sessions trial (No. 678 of 2025) arising from a case registered on 4 January 2025 at Chapra Town Police Station. He has been in custody since 5 January 2025, and the trial has proceeded with seven witnesses already examined. The petitioner contended that he was falsely implicated and therefore deserved bail. The Patna High Court examined the application and, noting the gravity of the alleged offence, found no basis to revisit its earlier orders denying bail. Consequently, the bail application was dismissed and the lower court was directed to expedite the trial.
