Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner.

Summary

The petitioner, Isha (also known as Sneha) Keshari, sought anticipatory bail fearing arrest in a case registered under IPC sections 498A, 306 and 34 relating to alleged dowry harassment and abetment of suicide. The prosecution alleged that the deceased, the sister of the informant, was harassed by several accused including the petitioner, leading to her suicide on 24 September 2022. The petitioner contended she was not an eye‑witness, had no direct involvement, and was implicated merely as the sister‑in‑law of the deceased, also highlighting her clean antecedents. The State opposed the bail, but the Court noted the general and omnibus nature of the allegations, the parity with co‑accused who had already been granted anticipatory bail, and the petitioner’s lack of direct culpability. Accordingly, the Court granted anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Informant is not an eye witness to the occurrence. Informant is

not an eye witness to the occurrence. Petitioner has falsely been

implicated in this case merely because she happens to be Gotni

(sister-in-law) of the deceased. Petitioner is separate in mess and

property and has got no concern with the affairs of deceased and

her husband. Allegation of torture and demand of dowry is

general and omnibus. As a matter of fact, the deceased herself

committed suicide and there is no allegation that this petitioner

played any role or instigated the deceased to commit suicide.

Moreover, similarly situated co-accused persons have already

been granted the privilege of anticipatory bail by this Hon’ble

of 2025. Petitioner is a lady and claims clean antecedents.

                        5. Learned A.P.P. for the State has vehemently

opposed the prayer for grant of anticipatory bail to the

          petitioner.

                        6. Considering the facts and circumstances of the

case, general and omnibus nature of accusation, claim based on

parity and clean antecedents of the petitioner, the prayer for

grant of anticipatory bail to the petitioner is allowed.
